This agreement is the long-awaited response to the sector\u2019s\u00a0<\/span><\/span><span class=\"TextRun SCXW70772116 BCX8\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW70772116 BCX8\">concerns<\/span><\/span><span class=\"TextRun SCXW70772116 BCX8\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW70772116 BCX8\">\u00a0about the real impact of\u00a0<\/span><\/span><span class=\"TextRun SCXW70772116 BCX8\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW70772116 BCX8\">Brexit<\/span><\/span><span class=\"TextRun SCXW70772116 BCX8\" lang=\"EN-GB\" xml:lang=\"EN-GB\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW70772116 BCX8\">\u00a0on the already very fragile air transport industry.<\/span><\/span><span class=\"EOP SCXW70772116 BCX8\" data-contrast=\"auto\">\u00a0First, Second, T<\/span><span data-contrast=\"auto\">hird and\u00a0<\/span><span data-contrast=\"auto\">F<\/span><span data-contrast=\"auto\">ourth freedom<\/span><span data-contrast=\"auto\">, are preserved<\/span><span data-contrast=\"auto\">\u00a0for a<\/span><span data-contrast=\"auto\">ll<\/span><span data-contrast=\"auto\">\u00a0EU and UK carrier<\/span><span data-contrast=\"auto\">s, scheduled and non-scheduled airlines, <a href=\"https:\/\/flyskylark.com\/en\/airplane-charter\/business-jet-rental\/\">private jet<\/a> operators.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><strong><span style=\"color: #a31010;\">For example: Any UK Carrier can operate scheduled services from Manchester to Warsaw, carry paying passengers on both directions and overfly the Netherlands and Germany on the way there.\u00a0<\/span><\/strong><\/p>\n<p><span data-contrast=\"auto\">The <a href=\"https:\/\/flyskylark.com\/en\/airplane-charter\/cargo-charters\/\">c<\/a><\/span><span data-contrast=\"auto\">argo operat<\/span><span data-contrast=\"auto\">ions\u00a0<\/span><span data-contrast=\"auto\">benefit<\/span><span data-contrast=\"auto\">\u00a0from less restrictions<\/span><span data-contrast=\"auto\">\u00a0and\u00a0<\/span><span data-contrast=\"auto\">the principle of\u00a0<\/span><span data-contrast=\"auto\">fifth Freedom has been agreed<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">However,<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">this must be\u00a0<\/span><span data-contrast=\"auto\">r<\/span><span data-contrast=\"auto\">eciprocally granted\u00a0<\/span><span data-contrast=\"auto\">by the UK and a member State<\/span><span data-contrast=\"auto\">\u00a0through bilateral a<\/span><span data-contrast=\"auto\">rrangements<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span style=\"color: #a31010;\"><strong>For example:\u00a0A\u00a0cargo aircraft operated by a Romanian\u00a0carrier can\u00a0carry cargo\u00a0between\u00a0East-Midlands and Jersey, as long as, before that\u00a0cabotage service,\u00a0the aircraft originates\u00a0from\u00a0a\u00a0EU\u00a0point.\u00a0<\/strong><\/span><\/p>\n<p><span data-contrast=\"auto\">UK and EU operators will be\u00a0<\/span><span data-contrast=\"auto\">considered\u00a0<\/span><span data-contrast=\"auto\">as third country operators in each other\u2019s airspace, therefore t<\/span><span data-contrast=\"auto\">he\u00a0<\/span><span data-contrast=\"auto\">other<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">level<\/span><span data-contrast=\"auto\">s<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">of\u00a0<\/span><span data-contrast=\"auto\">liberties previously granted\u00a0<\/span><span data-contrast=\"auto\">(including cabotage rights)<\/span><span data-contrast=\"auto\">\u00a0are\u00a0<\/span><span data-contrast=\"auto\">no longer\u00a0<\/span><span data-contrast=\"auto\">applicable.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Finally, the agreement\u00a0<\/span><span data-contrast=\"auto\">opens<\/span><span data-contrast=\"auto\">\u00a0the door to\u00a0<\/span><span data-contrast=\"auto\">ad-hoc\u00a0<\/span><span data-contrast=\"auto\">charter flight<\/span><span data-contrast=\"auto\">s<\/span><span data-contrast=\"auto\">\u00a0that\u00a0<\/span><span data-contrast=\"auto\">can operate with more flexibility<\/span><span data-contrast=\"auto\">, subject to prior authorizations\u00a0<\/span><span data-contrast=\"auto\">from the respective aviation authorities.\u00a0<\/span><span data-contrast=\"auto\">However, many <a href=\"https:\/\/flyskylark.com\/en\/airplane-charter\/business-jet-rental\/\">private jets<\/a> operators have observed that the derogatory authorizations have rarely been granted to them, so far.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">At the origin of this phenomenon, most likely we may soon identify a willingness of local carriers to play their veto of non-objection.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span style=\"color: #a31010;\"><strong>\u00a0For example: An Irish private jet operator wishing to operate an air ambulance between Glasgow and Cardiff would have to apply to the British <a href=\"https:\/\/www.caa.co.uk\/home\/\">CAA<\/a> to get the relevant authorizations\u00a0prior to the\u00a0chartered\u00a0mission.\u00a0\u00a0<\/strong><\/span><\/p>\n<p><strong><span style=\"color: #a31010;\">The same conditions apply to a\u00a0UK airline operating\u00a0an inclusive-tour\u00a0charter chain\u00a0between\u00a0Stockholm\u00a0and\u00a0Ibiza.\u00a0<\/span><\/strong><\/p>\n<blockquote><p><i><span data-contrast=\"auto\">\u201cHowever,\u00a0<\/span><\/i><i><span data-contrast=\"auto\">many private jets operators <\/span><\/i><i><span data-contrast=\"auto\">ha<\/span><\/i><i><span data-contrast=\"auto\">ve\u00a0<\/span><\/i><i><span data-contrast=\"auto\">observed that the derogatory authorizations have rarely been granted to<\/span><\/i><i><span data-contrast=\"auto\">\u00a0them, so far<\/span><\/i><i><span data-contrast=\"auto\">.\u201d<\/span><\/i><\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><img decoding=\"async\" data-contrast=\"auto\">\u00a0obtain the traffic rights between the\u202fUK\u202fand the\u202fEU, airlines from each side must be owned and effectively controlled by nationals of their own side, must have their principal place of business in their own territory, and must hold an AOC<\/span><span data-contrast=\"auto\">\u00a0(<\/span><span data-contrast=\"auto\">A<\/span><span data-contrast=\"auto\">ir Operator Certificate)\u00a0<\/span><span data-contrast=\"auto\">issued by the\u00a0<\/span><span data-contrast=\"auto\">competent authority in their own jurisdiction.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">UK\u202fairlines data-contrast=\"auto\">\u00a0count as\u202fUK\u202fairlines\u00a0<\/span><span data-contrast=\"auto\">even\u00a0<\/span><span data-contrast=\"auto\">if they are owned and effectively controlled by nationals of the\u202fEU\u202f(or the European Economic Area or Switzerland) or a combination of\u202fEU\u202fand\u202fUK\u202fnationals.\u00a0<\/span><span data-contrast=\"auto\">However, t<\/span><span data-contrast=\"auto\">his\u00a0<\/span><span data-contrast=\"auto\">does\u00a0<\/span><span data-contrast=\"auto\">not apply to\u00a0<\/span><span data-contrast=\"auto\">U<\/span><span data-contrast=\"auto\">K\u202f<\/span><span data-contrast=\"auto\">carrier\u00a0<\/span><span data-contrast=\"auto\">projects that<\/span><span data-contrast=\"auto\">\u00a0would\u00a0<\/span><span data-contrast=\"auto\">obtain\u00a0<\/span><span data-contrast=\"auto\">the<\/span><span data-contrast=\"auto\">ir operating license o<\/span><span data-contrast=\"auto\">n or after\u00a0<\/span><span data-contrast=\"auto\">01\/01\/2021<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"none\">Without th<\/span><span data-contrast=\"none\">ese provisions<\/span><span data-contrast=\"none\">, the\u00a0<\/span><span data-contrast=\"none\">English\u00a0<\/span><span data-contrast=\"none\">carrier\u00a0<\/span><span data-contrast=\"none\">that is a subsidiary of the Spain-registered IAG Group,\u00a0<\/span><span data-contrast=\"none\">could have lost its<\/span><span data-contrast=\"none\">\u00a0UK airlines status<\/span><span data-contrast=\"none\">.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">In the same manner, Ryanair had to<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">clarify their ownership and control structure<\/span><span data-contrast=\"none\">s<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">in order to<\/span><span data-contrast=\"none\">\u00a0keep their\u00a0<\/span><span data-contrast=\"none\">European<\/span><span data-contrast=\"none\">\u00a0carrier status.\u00a0<\/span><span data-contrast=\"none\">However,<\/span><span data-contrast=\"none\">\u00a0to keep on\u00a0<\/span><span data-contrast=\"none\">operating intra-U<\/span><span data-contrast=\"none\">K<\/span><span data-contrast=\"none\">\u00a0routes,\u00a0<\/span><span data-contrast=\"none\">Ryanair\u00a0<\/span><span data-contrast=\"none\">creat<\/span><span data-contrast=\"none\">e<\/span><span data-contrast=\"none\">d<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">a\u00a0<\/span><span data-contrast=\"none\">UK sister compan<\/span><span data-contrast=\"none\">y<\/span><span data-contrast=\"none\">\u00a0<\/span><span data-contrast=\"none\">(with\u00a0<\/span><span data-contrast=\"none\">significant differences in terms\u00a0<\/span><span data-contrast=\"none\">of\u00a0<\/span><span data-contrast=\"none\">ownership
